This article summarizes the recent history of the Waters of The United States (WOTUS) in the Navigable Waters Protection Rule, published on April 21, 2020, and reviews which surface water bodies are considered and not considered WOTUS. The article provides clarity on the surface water bodies governed by State versus federal jurisdiction and how the ruling influences agricultural and specialty crop stakeholders.
